PRIME Photography & Videography - Terms and Conditions

1. Payment
1.1 A non-refundable deposit of £500 is required to secure the event package on the day of booking. The remaining balance must be paid in full on or before the event day. No exceptions or delays will be accepted.
1.2 Clients not opting for a package (e.g., photography-only or videography-only services) must make full payment upon booking to confirm their reservation.
1.3 In the case of cancellation or postponement, PRIME Photography must be notified no less than 8 weeks prior to the original scheduled date. A new event date cannot be confirmed without our approval.
1.4 In the event of delayed payment on the day of the event, the ownership of all deliverables (photos, videos) will remain with PRIME Photography until full payment is received.

2. Force Majeure
2.1 In the unlikely event of cancellation or failure to deliver services by the photographer, liability will be limited to a full refund of any fees paid.
2.2 Should the photographer be unable to attend due to unforeseen circumstances (e.g., illness, injury, accidents, adverse weather, or transportation issues), PRIME Photography will make reasonable efforts to provide a substitute photographer.
2.3 While all equipment is regularly checked, PRIME Photography is not liable for any missed images due to technical failure.
2.4 In cases of extreme weather, PRIME Photography may suggest alternative locations for the shoot. However, clients will be responsible for any additional venue hire costs if necessary. Clients are also welcome to reschedule or return to our studio for their session.

3. Service
3.1 PRIME Photography provides assistance with navigating our app, event planning, location scouting, permissions, and other client support. However, clients are solely responsible for renting, booking, or hiring locations, products, or services.

4. Photographic Materials, Copyright, and Confidentiality
4.1 All photographic materials, including negatives, RAW files, photos, and videos, remain the exclusive property of PRIME Photography.
4.2 PRIME Photography retains full copyright over all images and videos and reserves the right to use them for portfolio, advertising, social media, and promotional purposes. Any additional use outside of this agreement requires the client’s written consent.
4.3 Should a client request the removal of their images or videos from public platforms, PRIME Photography will comply promptly.
4.4 All confidential information provided by the client will be kept strictly confidential and will not be shared with third parties without the client’s consent.

5. Travel and Accommodation
5.1 PRIME Photography provides international services, and clients are responsible for covering all travel-related expenses, including flights, accommodation, car rentals, and any other necessary arrangements for the team.
5.2 Additional rentals for photoshoots, such as boats, motorbikes, or venue entry fees, will also be covered by the client.

6. Liability
6.1 Any directions given to clients, guests, or staff during a photoshoot are followed at their own risk. PRIME Photography is not liable for any injuries or accidents that occur during the shoot.

7. Delivery
7.1 Deliverables, including albums and videos, will be provided within 6-8 weeks after the event. This timeline may extend during busy periods.
7.2 Images will be delivered in high-quality JPEG format, and videos will be provided in 4K MP4 format. RAW files are not provided unless explicitly requested by the client.
7.3 Clients must supply their own hard disk for the transfer of all relevant video footage.

8. Editing
8.1 All images will undergo basic colour correction unless the client requests additional retouching or specific edits.

9. Archiving
9.1 PRIME Photography guarantees the storage and archiving of all deliverables for 1 year after delivery. Beyond this period, we cannot be held liable for lost or damaged files. Clients are encouraged to back up their deliverables upon receipt.

10. Exclusivity
10.1 The client agrees that no other professional or amateur photographer will be allowed to photograph or film at the event while PRIME Photography is performing its services. Any breach of this agreement may result in immediate termination of the contract, with no liability to the photographer or obligation to deliver further services or products.

11. Governing Law and Jurisdiction
11.1 These terms and conditions are governed by the laws of England Jurisdiction. Any legal disputes arising from this agreement will be handled exclusively in the courts of England, London.
